TERMS & CONDITIONS
Pick up for all horses is by the end of day on Sunday. We accept cash, debit, credit, and cashier’s checks. NO PERSONAL CHECKS! If you need to make arrangements for your horse to stay longer while you make transportation arrangements, please contact the office on Sunday. We can board your horse until Friday following the sale. Unfortunately, we do not have the room to board your horse any longer. Board fees will apply at $10/day per head.
Payment is due by the end of auction day.

BIDS – The highest bidder will be the buyer and if a dispute arises between two or more bidders, the horse in dispute shall immediately be put up again for advance bids. If there is no advance the horse shall go to the person from whom the auctioneer recognized the last bid. The auctioneer will decline any bid made by parties who have defaulted in former purchases or by persons, who, in his judgement, are not responsible bidders. The consign or shall have the right to pass out or no sale his/her horse. All consignors who no sale their animal must do so prior to the animal leaving the sales ring.
Title passes to buyer at fall of the hammer. All risk of injury to the horse becomes buyer's risk at passing of title. buyer agrees to release, defend, indemnify and hold owners, managers, and employees harmless from all losses, expenses, and claims related to the possession, care, custody, control or maintenance after the fall of the ham mer of any horse on which he or she is the suc cessful bidder, whether resulting in whole or in part from their own negligence, including but not limited to any claims arising out of injuries or damage caused by the horse after the fall of the hammer. The horse will be held for buyer until buyer makes settlement as provided. Buyer shall immediately present himself to make settlement if requested by auctioneer, but in any case shall present himself within thirty (30) minutes of con clusion of the sale. Buyer is responsible to check registration and additional paperwork at time of settlement.
Any livestock leaving the state of Washington must have a health certificate to cross state lines. Horses must have a health certificate and a negative coggins before crossing state lines. These tests are the buyer's responsibility, ESP will help get the test done.

If your horse is going out of state, the coggins will not be ready until the end of day Thursday following the auction so pick up will be Friday from 9am-5pm. ESP will keep the buyer updated on the status. Board fees will apply at $10/day per head.

Horses are not sold to pass a post purchase veterinarian exam and rideblity is not guaranteed. Please do your own due diligence - examine and shop horses prior to bidding. Our Soundness Guarantee is defined as: sight out of both eyes, good in the air, hit the ground sound on all four, and does not crib. Soundness determination will be made by ESP staff NOT a post purchase veterinarian exam.
NOTE: All horses will sell AS IS unless a guarantee is made by the consignor.
ALL GUARENTEED SOUND HORSES ARE GUARENTEED BY THE CONSIGNER TO THE BUYER NOT ESP. A SOUNDNESS GUARENTEE IS 72 HOURS ONLY.
If you purchase a horse that is guaranteed sound in our catalog or in the ring when it sold and you believe it is not sound, you must contact ESP (360) 825-3151 or email Enumclawsp@gmail.com by Tuesday at noon of that week. Horses must be brought back on site to ESP within the 72 hour window. We will not honor post-purchase veterinary. exams.
In order for a horse to be guaranteed sound, it must be written in the catalog or announced in the ring when it sells. (In the ring, we will have it on the video.)
There are plenty of horses that sell through the ring and are not guaranteed sound for one reason or another. However, if a horse is NOT guaranteed sound in our catalog or in the ring when it sells, you need to consider them not sound. ESP cannot guarantee the horse’s ride ability OR how the purchaser rides.

TERMS & CONDITIONS
Enumclaw Sales Pavilion (ESP) and its associates act as agents only and are not responsible for buyer/seller error or misunderstanding. All guarantees are strictly between the buyer and seller. Horses will be sold as registered only if original registration papers and a current transfer are supplied to the office by day of the horse sale. If such paperwork is not supplied, your horse will be sold as grade. If you are selling a mare as guaranteed bred, you will need to supply a breeders certificate to the office by day of the sale. If selling a horse with a registration application, you will need to supply a fully completed application along with a transfer from the owner of dam at time of foaling. ESP and its associates reserve the right to withhold proceed checks until proper paperwork has been obtained.
All No Sales/Pass Outs must be declared in the ring. Once you have left the ring, the horse is considered sold unless verbally no sales/passed out in the ring. If the horse is a No Sale/Pass out, entry fee is due prior to leaving with your horse.

All horses consigned to ESP’s cataloged horse sale will run through the ring. CONSIGNOR AGREES TO NOT PRIVATELY SELL OR WITHDRAW CONSIGNED HORSE(S) TO SALE unless injured or sick with a vet release and photo/video is submitted to the office.
There is a $500 no show fee without a vet release and photo/video.
All consignments must go through the sale ring. NO alley trading is allowed. If while still on ESP property and you are approached after the sale by a buyer, you must contact the main office to change from a no sale/pass out to a sale. This allows for proper legal paperwork. This is a binding contract. You are consigning your horse to sell at the ESP Catalog Horse Sale. Horses are advertised and expected to sell AT THE HORSE SALE.

All blemishes that do not affect the horse’s soundness (scars, chewed tail, cinch sores, with marks, bumps, etc) are to be declared at time of consignment. Vices such as cribbing and weaving need to be disclosed as well as any extra required maintenance.
Consignor agrees to provide truthful, accurate information. If there is credible information that the horse is misrepresented, ESP has permission to change or pull the listing from the sale.
Limited Warranties: The seller is the responsible party for all representations or warranties, expressed or implied concerning the condition of any horse and buyers should satisfy themselves concerning the condition of any animal they purchase. Except as otherwise announced by the auctioneer at the time of sale. The consignor of each animal represents warrants to the buyer and ESP, the following:
Title of the animal is free from all adverse claims to ownership, use of possession.
The animal is sound of eye and wind.
The animal is not a ”Cribber,” Wind Sucker,” have “Heaves,” or a “Weaver.”
The animal has not been nerved.
The sex or conditions as a gelding or ridgeling is as described as a colt and does not apply to any horse sold prior to Dec. 31 of his yearling year.
All mares that have been spayed must be so stated.
The animal is not deaf.
If any of these conditions is announced the consignor is held harmless for the condition WITHOUT WARRANTY AND WITH ALL FAULTS. Every horse is sold under this rule; therefore, no horse can be rejected by the buyer when struck off by the auctioneer, except in the event one of the above conditions is not announced by the seller in the sale ring. There is no guarantee of any horse sold in this sale except when the owners makes a specific guarantee. In such case right of recourse must be directed to the seller. In the event of any dispute all information in our possession as to address and telephone numbers will be provided to both parties.
We will NOT ACCEPT:
Extremely thin horses;
Horses that can not bear weight on all 4 feet;
Blind horses;
Obviously sick animals;
Injured or bleeding animals;
Weaned foals under 200 pounds.

Coggins and Health Certificate should be the original copy supplied to you by your veterinarian. They are to be supplied to the office by check in time for your horse. All horses coming from out of state are REQUIRED to have a health certificate and coggins.
Proof of Ownership: If your horse has a brand or is registered, you must bring proof of ownership with you for the brand inspector. If the horse is registered and in your name, that will qualify as proof of ownership. If the horse is not registered, you will need to provide a bill of sale for the brand inspector, which needs to include the brand on the bill of sale.
ESP will provide your horse alfalfa. If your horse needs another type of hay, you will be required to bring your own.
THIS IS A BINDING CONTRACT. UPON SUBMISSION OF ANY/ALL CONSIGNMENT CONTRACTS, CONSIGNOR AGREES TO ABIDE BY ALL TERMS AND CONDITIONS DISCLOSED IN THESE TERMS AND CONDITIONS AS WELL AS INFORMATION INCLUDED IN/ON CONSIGNMENT CONTRACT AND WEBSITE.
